Police Powers

Taylor & Kelly act for many people who challenge as unlawful, the conduct to the police towards them.  Taylor & Kelly have been successful in claiming damages from police forces as a result of unlawful conduct.

Before the Courts Taylor & Kelly have not been slow in putting forward challenges which seek to focus and refine the law applicable between police and citizen.

Beck v Strathclyde Police: A challenge was made to the arrest without a warrant of a Taylor & Kelly client on the basis of driving without insurance.  This was appealed to the Inner House of the Court of Session.

Police Complaints 

Taylor & Kelly have on behalf of an individual client complained about the lack of independence and thus convention compatibility of the police complaints system.  Article 3 of the European Convention in Human Rights laid down particular implied obligations upon the State.

The appeal proceeds at the Inner House of the Court of Session.
